1. This Regulation establishes the list of forwarding documents, the order of delivery and quality requirements for transportation and forwarding services.
2. Relations between the forwarder and the client are governed by the Civil Code of the Russian Federation, Federal Law "On forwarding activities, these Rules and the contract freight forwarding.
The relationship between forwarders and carriers in different modes of transport are governed by the Civil Code of the Russian Federation, the transport charters and codes.
3. These Regulations shall not apply to freight-forwarding services in the field of postal communication.
4. Definitions used in this Regulation mean the following:
"Forwarding services" - services for the organization of cargo transportation, the conclusion of contracts of carriage of goods, to ensure sending and receiving of goods, as well as other services related to cargo transportation;
"Freight forwarder" - a person performing or procuring the execution of certain contract of freight forwarding freight forwarding services;
"Client" - the person who has entered into a contract with the freight forwarder freight forwarding and has taken the obligation to pay in freight forwarding services to the freight forwarder;
"Contract of transport expedition" - a civil law transaction whereby one party (shipping agent) reward undertakes on behalf and at the expense of the other party (the client) to provide freight forwarding services;
"Goods" - any property in respect of which the freight forwarder is organizing transportation in accordance with the contract freight forwarding;
"Shipper" - a person that presented the goods for transportation;
"Consignee" - the person authorized to take delivery at the freight forwarder after shipment;
"Carrier" - the person having the carriage of goods on the basis of contract of carriage.
5. Forwarding documents are:
• Order Agent (defines the list of conditions and the provision of freight forwarder customers forwarding services within the contract freight forwarding);
• forwarding a receipt (confirms receipt of the freight forwarder for transportation of goods from a customer or referred to them by the shipper);
• warehouse receipt (freight forwarder confirms the adoption of the client load on storage).
6. Depending on the nature of forwarding services, including the transport of goods in international traffic, the parties agreed freight forwarding can be determined by the possibility of using the forwarding of documents not listed in paragraph 5 of this Regulation.
7. Forwarding documents are an integral part of the contract of transport expedition.
Forwarding documents be drawn up in writing. The order of registration forms and forwarding the documents approved by the Ministry of Transport of the Russian Federation.
8. In order to provide freight forwarding services to customers given the completed and signed their order to the freight forwarder. The duly instructed the freight forwarder must contain accurate and complete information about the nature of the cargo, its labeling, weight volume, and the number of packages.
Order forwarder seems to him by the client in hard copy, if a method does not provide the contract freight forwarding.
9. Considers the order to the freight forwarder Freight Forwarder in the terms defined in the contract of freight forwarding, and forwards it to the client with a mark of coordination or the refusal to agree to be the provision of freight forwarding services with the reasons for refusal.
10. Order to the freight forwarder is subject to execution of the receipt of the client written confirmation of its approval forwarder.
Client at any stage of execution of the contract of transport expedition has the right to withdraw the previously issued order to the freight forwarder with the necessary compensation for his actual costs associated with the execution order.
Withdrawal orders issued by the freight forwarder is the client in writing.
11. The procedure and conditions for submitting assignments forwarder and customer feedback order issued by the freight forwarder using facsimile or electronic communication are determined by the contract of freight forwarding.
12. Forwarding a receipt issued by forwarder to the client when receiving cargo and freight forwarder provides ownership of the goods until the goods are handed over to the client or indicated by the consignee at the end of the carriage.
13. If the dispatcher takes the goods to the customer's storage, the freight forwarder provides the client with a warehouse receipt.
14. Unless otherwise established by contract freight forwarding, the organization of cargo transportation freight forwarder if necessary, provides:
• agreement with the carriers conditions of carriage and storage of goods, time of transhipment from one mode to another, and other issues necessary for the implementation of transportation;
• customs clearance and other procedures required for the implementation of transportation;
• payment for shipping with the carriers as the client's behalf, and on its behalf.
15. According to the customer the freight forwarder provides the following information:
• full name and location (for legal persons), name and place of residence (for individual entrepreneurs);
• information on conformity assessment of forwarding services requirements;
• a list of forwarding services to the freight forwarder, and their value;
• information on the form and procedure for payment of freight forwarding services;
• information on tariffs for the carriage of goods by various modes of transport, the rules and conditions of such transport;
• other information relating to the organization and implementation of specific types of cargo transportation by different modes of transport.
16. Freight Forwarder in cases stipulated by the contract of transport expedition, when receiving goods from the carrier at the destination involved in the design of relevant documents.
17. Freight Forwarder in the provision of certain contract freight forwarding freight forwarding services is obliged to follow the client.
Forwarder has the right to deviate from guidelines client only if it is necessary for the client or if the freight forwarder to circumstances beyond his control failed to advance to request client in the manner determined by the contract of transport expedition, his consent to such exemption or obtain within days after notification to the customer response to your request.
18. Hazardous, perishable and other goods requiring special conditions of carriage, freight forwarder accepted only if the representation of the client in writing information about conditions of their transportation.
19. Quality of freight forwarder freight forwarding services must meet the requirements of national standards of the Russian Federation, normative legal acts in the field of freight forwarding activities, as well as conditions of the contract freight forwarding.
